TERMS & CONDITIONS
These Terms and Conditions govern the relationship between you, the passenger, and us, One Ocean Sailing PTY LTD (herein after, “One Ocean Sailing”). By booking a trip, you agree to be bound by these Terms and Conditions. They outline, among other things, our cancellation policy and certain limitations of liability. Please carefully read these terms and make sure you understand them clearly.
RESERVATIONS AND PAYMENTS
A deposit of 50% of the full cruise price is required to secure your reservation. To secure reservations on a cruise departing within 14 days, a full payment is required by credit card or direct transfer at the time of booking. Payment of your deposit indicates your acceptance of these terms and conditions.
Final payment for all cruises must be made in full to One Ocean Sailing at least 14 days prior to departure. Reservations will be cancelled if final payment is not received by 10 days prior to the cruise date and cancellation charges will apply.
Cruise prices are listed as hire for the whole boat, unless otherwise stated. Every effort has been made to produce pricing information accurately. We reserve the right to correct errors. Quotes given are valid for a period of 3 months. For ticketed per/person cruises, all bookings must be paid for in full, and are non-refundable and non-transferable.
Cruise routes are a guide only, weather dependent and subject to change without notice. Anchoring stops may be impacted by weather and are left to the skipper’s discretion on the day.
CANCELLATIONS AND REFUNDS
If you must cancel your trip, you must do so in writing to info@oneoceansailing.com. Cancellation refunds will be calculated from the date we receive your written cancellation.
Cancellations and date changes within 72 hours of the cruise date incur a 100% fee and no refund will be offered.
Cancellations between 72 hours and 10 days incur a 50% rescheduling/cancellation fee.
One Ocean Sailing cruises are generally not affected by weather and will proceed in all weather conditions. “One Ocean” contains indoor and outdoor areas for use. If One Ocean Sailing deems the weather conditions unsafe, your charter will be rescheduled to an alternative date that is agreed upon with you and One Ocean Sailing. No refund will be offered.
One Ocean Sailing cannot make exceptions to these cancellation policies for any reason, including personal emergencies and weather.
MEDICAL & SAFETY
By booking a charter with One Ocean Sailing, you declare that you are in a fit and healthy state to undertake the events of your cruise and that you have no pre existing medical condition or injury which would affect your competence on the boat or on the water. If you or your guests are not confident swimmers, you must advise One Ocean Sailing prior to boarding the vessel.
Your cruise on Sydney Harbour includes activities that may involve considerable risks and dangers. Whilst care is taken to ensure your safety on board and in the water, we accept no responsibility for injury, damage or losses incurred.
You must inform One Ocean Sailing prior to your cruise date if you have any food allergies or health conditions which may affect your safety on the cruise.
You must listen and obey to all safety instructions given to you by One Ocean Sailing, skipper or crew at all times.
The person making the charter booking will be responsible for the cost of all damages and breakages caused by all guests on board. There will be a security bond held on the credit card taken at booking, and any damages will be deducted from this bond.
Jumping/diving from the boat is dangerous and not recommended. You do so at you own risk. Jumping/diving from the roof of the boat is not allowed.
Access to the roof of the vessel is not allowed
Always use sunscreen and drink lots of water.
CHILDREN
Children are able to join a cruise, providing they are accompanied by an adult, and have made prior arrangements with us. Supervision at all times remains the responsibility of the parent or guardian.
RESPONSIBILITY
Times agreed upon for the cruise include boarding and disembarkation. Please arrive at the pick up location no less than 20minutes before departure time. If guests are not ready for boarding due to no-show or late arrival, One Ocean Sailing cannot guarantee cruise participation and all moneys will be forfeit.
The responsibility of One Ocean Sailing and its affiliated companies is strictly limited. As a tour operator, One Ocean Sailing organizes, promotes, and sells tour programs consisting of certain travel services, including land and water transportation and sightseeing excursions.
One Ocean Sailing does not own or operate any other supplier or company. Should you wish to participate in other independent contractor’s activities or tours, One Ocean Sailing is not responsible for any negligent or willful act or failure to act of any supplier or of any third party.
The skipper, crew, and charter company accept no responsibility for your safety or for any injury incurred once you have left the vessel, whilst in the water or when re-boarding the vessel from the water. If you leave the vessel to enter the water you do so at your own risk and you are solely responsible for any injuries incurred. You will be asked to sign a ‘Swimming & Injury Waiver’ on the day, before leaving the vessel.
All participants must agree to indemnify and hold One Ocean Sailing, its insurers, affiliates and representatives, harmless for any injury or death arising from swimming, stand-up-paddleboarding, kayaking, or the use of dinghies, snorkels, masks, or other equipment, the use of drugs or consumption of alcohol. One Ocean Sailing cannot be held accountable for any injury caused by malfunction of a vessel that is not owned and maintained by One Ocean Sailing. In the case of an injury, the passenger remains responsible for the negligent acts that may result in harming themselves or other passengers or crew. One Ocean Sailing will not be held responsible for any personal injuries, equipment loss or damage sustained while participating in charters. Passengers may get wet, and are advised to leave valuables undercover in a safe/dry place.
One Ocean Sailing and it’s representative, have the right to suspend the activity and participation of any client on any One Ocean Sailing cruise if behaviour is deemed erratic, unsafe, belligerent, or defiant of captains’ commands and directions. The client will not be refunded and will be responsible for any and all extra financial costs if they are required to disembark before the end of the cruise. Erratic and unsafe behaviours includes but is not limited to excessive drinking of alcohol, drug use, unsafe practices aboard, damaging the boat, willful defiance of the captain and their commands (in regards to safety), sexual harassment, physical and verbal violence.
Alcohol will be refused to any intoxicated passenger and is only to be consumed by people 18 years and over. Passengers are advised to obey alcohol consumption RSA guidelines of no more than 6 standard drinks in one day.
Passenger numbers are limited to the capacity stated when booking the cruise, including children. Under no circumstances will One Ocean Sailing allow passenger numbers to exceed this. The skipper reserves the right to refuse entry to any passenger numbers above this stated number.
One Ocean Sailing reserves the right to take photographic or film records of any of its cruises, and to use any such photographic or film records for promotional and/or commercial purposes.
APPLICABLE LAW
This relationship shall be governed by the laws of the State of Australia. Any claims against One Ocean Sailing must be brought in the Federal or State Courts located in the State of Australia, to the exclusion of the Courts of any other state and country.
INTELLECTUAL PROPERTY
All materials including copy, photographs, design, logo mark, and written materials contained on the One Ocean Sailing website are reserved and intellectual property owned, controlled or licensed by the One Ocean Sailing, or, otherwise noted. No photograph, copy, or journey can be used or solicited to an outside source without permission with signed contract from One Ocean Sailing.
USE OF CONTENT
The One Ocean Sailing website and all its contents are intended for personal use only. Content and other downloadable content is for personal use by One Ocean Sailing passengers and participants only and cannot be used for any other purposes.
